Professional marketplace agreement
1. Parties and approval
The Legend Crew LLC operates Legend Clean Pro. Each professional must provide accurate business and contact details and identify the services and NYC boroughs they can serve. Profiles become visible only after business review. Do not claim licenses, insurance, screening, or qualifications that you cannot substantiate.
Before the first job, a written agreement must identify the actual legal parties and addresses, the provider’s business structure, services, responsibility for supplies, taxes and insurance, compensation, any platform fees, payment timing, cancellation terms, and dispute procedure. The application form does not collect all information needed for that agreement.
2. Work and classification
Professionals may state the services and areas they offer and must have a meaningful opportunity to accept or decline a proposed assignment before committing. Once accepted, provide the agreed work with care and communicate access or safety issues promptly.
Calling someone an independent contractor does not determine their legal status. The business must evaluate the real working relationship under applicable New York and federal tests. If a worker is an employee, required wage, overtime, leave, insurance, payroll, and other protections apply regardless of this draft. No provision requires a worker to waive nonwaivable rights.
3. Contracts and payment protections
When applicable, NYC’s Freelance Isn’t Free Act protects written contracts, timely full payment, and freedom from retaliation. The parties must also check the statewide law and other applicable protections. Use a compliant written job agreement and pay by the agreed lawful deadline; customer collection delays do not automatically excuse a hiring party’s statutory duties.
Public service rates, discounts and any effect on professional compensation must be agreed before an assignment. Before payment onboarding, the professional must explicitly accept the commission percentage shown in their account. The commission applies to the discounted service price, excluding tax, and is rounded to the nearest cent. A changed rate requires renewed acceptance before new checkout. The platform pays Stripe processing fees under this destination-charge implementation; any other fee allocation needs a separate lawful agreement. An example is not an agreed rate.
4. Compensation and records
Stripe Connect collects identity, tax and bank details on hosted onboarding pages. The application stores the Stripe account identifier, commission rate and acceptance time. Do not enter bank or tax-identification data in an application, booking note, or support message.
The configured independent-seller model transfers the customer payment, including collected service tax, to the professional’s Stripe account less the agreed marketplace commission. The professional is the settlement merchant and, only where legally correct for the actual relationship, the party responsible for the service’s tax registrations, returns and remittance. Stripe settings do not determine legal tax liability. This model must be reviewed before activation; if The Legend Crew LLC is legally the seller or owes the tax, the configuration must change before independent-professional payments are accepted. Stripe tax calculation does not automatically register a business or file returns.
Bank payout timing depends on Stripe verification, available balances, payout settings and reserves. No immediate or guaranteed payout date is promised. Compensation, the responsible paying party, and lawful payment deadlines must be agreed in a written job agreement before work starts. Customer collection delays do not eliminate statutory payment duties. Maintain business and tax records.
Full customer refunds initiated through the business dashboard request reversal of the professional transfer and return of the platform commission. Processing fees may not be returned. Stripe debits the platform for destination-charge disputes; recovery from a professional requires a lawful agreed basis and review. Partial refunds, insufficient balances and failed reversals require manual reconciliation, without limiting customer or worker rights.
5. Safe work and customer respect
Follow applicable safety, consumer, anti-discrimination, privacy, licensing, and insurance requirements. Use suitable products and equipment, obtain permission before changing materials or scope, and do not undertake hazardous or regulated work beyond qualifications. No discrimination, harassment, retaliation, deception, or misuse of customer information is permitted.
Use customer information only to perform the accepted service and resolve legitimate issues. Do not publish home addresses, access instructions, or client images without appropriate permission. Report incidents promptly and preserve relevant records. Screening, if introduced, requires a separate lawful process; application approval is not a background-check certification.
6. Leaving the marketplace
Either party may request an end to future marketplace participation, subject to lawful duties for already accepted work and amounts owed. Restriction or removal must not cancel earned compensation or protected rights. No non-compete, mandatory arbitration, or blanket indemnity is created by this application draft.
